INJUNCTION STOPS EX-EMPLOYEE’S NON-COMPETE BREACH

Our office obtained a temporary restraining order and preliminary injunction order against our client’s former employee’s company which enjoined the former employee from competing against our client in the plastics and recycling industry or soliciting its customers.

Our client is a small business owner in the plastics and recycling industry. Its former employee violated their non-compete and non-solicitation agreement that was signed as a condition of unemployment with our client’s business.

Months after leaving our client’s company, they formed an industry competitor which performed identical services. To circumvent the agreements the former employee signed, they formed the industry competitor through their spouse. Worse yet, the former employee and their spouse clearly concentrated their efforts on soliciting customers associated with our client’s book of business with whom former employee developed an industry relationship.

If our office did not intervene, our client faced the possibility of seeing their business’s book of business pillaged. As soon as our client learned their former employee was engaging in these business practices, they hired our firm to enjoin their former employee’s company from conducting business in the plastics and recycling industry and from soliciting our client’s customers.

Our office obtained successful results almost immediately. Our office obtained a temporary restraining order and preliminary injunction order against former employee’s business within two months of initiating litigation. This was an excellent result and likely saved our client’s business.
