Our office successfully negotiated a favorable plea deal in a delayed Operating While Intoxicated case involving an occupant under 16 years old, reducing the charge to careless driving and disorderly conduct.
Our office represented a client charged with operating while intoxicated with an occupant under 16 years old, stemming from a domestic incident nearly four years prior. The client had been fleeing a domestic violence situation at the time of the arrest, which was corroborated by police who arrested the assailant. Charges were only filed after the client inquired about a hold on their driver’s license. Through detailed advocacy highlighting evidentiary issues—including a four-year-old blood draw that could not be independently tested, inconsistencies in field sobriety tests influenced by recent trauma, and the client’s exemplary conduct since the incident—we secured a plea deal that saw the client plead from OWI to careless driving and disorderly conduct. This agreement avoided mandatory license suspension, preventing undue hardship on her family and employment. A major victory for our client.
